Most legal mistakes expats make in the Netherlands are deadline mistakes: you must register with the municipality within five days of arrival, arrange basic health insurance within four months, and object to an IND decision within four weeks. The most important exception to “you can fix it later” is employment: a court challenge to your dismissal lapses two months after the employment ends and cannot be extended.
The Dutch system is rules-based and largely automated, which makes it predictable but unforgiving. Below are the seven areas where internationals most often lose rights, with the rule and the deadline for each.
When must you register with the municipality?
If you expect to spend at least two thirds of the next six months in the Netherlands, you must register in person at your municipality no later than the fifth day after arrival, under Article 2.38 of the Personal Records Database Act (Wet BRP). On registration you receive a citizen service number (burgerservicenummer, BSN).
Without a BSN you cannot be put on a Dutch payroll, take out health insurance or obtain DigiD for online contact with government bodies. Registration is your own obligation, not your employer’s or landlord’s, and it does not give you a right of residence. If you stay for a shorter period, you register as a non-resident (RNI) and still receive a BSN.
Report every move within the Netherlands and your departure abroad. Letters from the Tax Administration (Belastingdienst) and the IND go to your registered address, and an old registration that is never closed keeps you administratively resident.
Why is the residence permit more than a formality?
Each residence permit under the Aliens Act 2000 (Vreemdelingenwet 2000) has its own conditions, and the IND assesses your application against the purpose you chose. An application under the wrong purpose is refused, not converted.
The main routes for internationals are the highly skilled migrant scheme, the single permit for work and residence, study, family reunification, self-employment and the start-up route. Salary and income thresholds change every 1 January and often every 1 July, so check the current figure on ઇન્ડ.એન. A permit stays conditional. Losing your sponsoring employer, dropping below the salary norm or ending a relationship can lead to withdrawal, and you must report such changes to the IND.
What if the IND decides against you or decides too late?
Under Article 69(1) of the Aliens Act 2000 you have four weeks to object (bezwaar), not the six weeks of general administrative law. Since 15 April 2025 the IND no longer owes an administrative penalty (dwangsom) for deciding late; you can still send a notice of default and then appeal to the court for failure to decide. What should you check in a Dutch employment contract?
Most Dutch employment law is mandatory: a clause that gives you less than the Dutch Civil Code (BW) allows is void. The risk is not an unfair clause, but not knowing which protections exist and letting them lapse.
Probation: under Article 7:652 BW a contract of six months or less cannot contain a probationary period. The maximum is one month for a fixed-term contract of more than six months but less than two years, and two months for a fixed-term contract of two years or more or an open-ended contract. A probation clause that exceeds the maximum is void.
Fixed-term contracts: under the chain rule of Article 7:668a BW the last contract becomes open-ended once more than three fixed-term contracts have followed each other, or once they have exceeded 36 months, with gaps of six months or less. Our explanation of the સાંકળ નિયમ shows how the counting works.
Non-compete: under Article 7:653 BW a non-compete clause in a fixed-term contract is valid only if the employer explains in writing, in the clause, why it is needed for compelling business interests. In an open-ended contract it must be agreed in writing with an adult employee, and the court can still annul it in whole or in part. See our notes on the
What protects you on dismissal?
An employer needs your written consent, a UWV permit (for redundancy or long-term illness) or a decision of the subdistrict court (kantonrechter) to end an open-ended contract. Under Article 7:673 BW a transition payment (transitievergoeding) is due from the first day of employment, unless the dismissal is caused by your seriously culpable conduct or one of the other statutory exceptions applies.
Under Article 7:686a(4) BW a request to the court about a dismissal lapses two months after the employment ended; a claim for the transition payment lapses after three months. If you sign a settlement agreement, Article 7:670b BW gives you 14 days to dissolve it without reasons, or three weeks if the agreement does not mention that right.
A choice of foreign law in your contract does not remove the protection of mandatory Dutch employment rules if you habitually work in the Netherlands. A notice period agreed in writing may be longer than the statutory one, but under Article 7:672(8) BW the employer’s period must then be at least twice the employee’s.
What changed in Dutch tenancy law?
Since 1 July 2024 the Fixed-Term Tenancy Act (Wet vaste huurcontracten) has made the open-ended lease the norm for residential tenancies, and the Affordable Rent Act (Wet betaalbare huur) has extended binding rent caps to the mid-rental segment. A temporary contract that does not fit a statutory exception is treated as open-ended, with full protection.
The Good Landlordship Act (Wet goed verhuurderschap) requires a written lease and written information for the tenant, and prohibits discrimination and intimidation. Under Article 7:261b BW the deposit is at most twice the basic monthly rent and must be repaid within 14 days after the lease ends, or within 30 days if there is damage. See our article on the
Under Article 7:249 BW you can ask the Rent Tribunal (Huurcommissie) to test your initial rent up to six months after the lease started. After that, the agreed rent stands.
Almost everyone who lives or works in the Netherlands must take out Dutch basic health insurance. If you take it out within four months after the obligation arose, the cover is backdated to that date under Article 5 of the Health Insurance Act (Zorgverzekeringswet), and you pay the premiums for that period.
If you stay uninsured, the CAK sends warnings, imposes fines and can register you with an insurer. Travel insurance or an employer’s international policy does not satisfy the obligation. Posted workers and people insured in another EU country may be exempt, but this must be established with an A1 certificate or a decision of the Social Insurance Bank (Sociale Verzekeringsbank), not assumed.
Do your home country’s rules travel with you?
Often not. Under the EU Succession Regulation your estate is governed by the law of your habitual residence at death, unless you chose the law of your nationality in a will, so an expat living here is usually subject to Dutch inheritance law.
For couples married on or after 29 January 2019, the EU Matrimonial Property Regulation applies; without a choice of law, it points to the law of your first common habitual residence after the marriage. A choice of law before a notary removes that uncertainty. See our articles on the
Unmarried partners have no statutory inheritance right under Book 4 BW, however long they live together. Without a will and a notarial cohabitation agreement, a surviving partner inherits nothing.
We do not give tax advice. If you are resident for tax purposes, you generally declare your worldwide income to the Belastingdienst, with double taxation relieved under a tax treaty. The expat facility (the 30% ruling) has changed several times, so have a tax adviser check the current conditions before your first Dutch payroll.
Which deadlines matter most?
Dutch law runs on periods that expire without warning. A government decision becomes final if you do not object in time, and the court will then not look at the merits. Under Article 3:317 BW a written notice in which you unequivocally reserve your right to performance interrupts the limitation period of a claim.
- Municipal registration: no later than day five after arrival.
- Health insurance: within four months for backdated cover.
- Objection against an IND decision: four weeks.
- Challenge to a dismissal: two months after the employment ends; transition payment claim: three months.
- Settlement agreement: 14 days to change your mind (three weeks if not mentioned).
- Test of the initial rent: within six months after the lease started.
What can we do for you as an expat in the Netherlands?

- We draft and file your objection against an IND decision within the four-week deadline.
- We check whether your temporary lease and initial rent comply with the law and file a request with the Rent Tribunal.

What happens if I do not register with the municipality in time?
Registration is required no later than the fifth day after arrival if you expect to spend at least two thirds of the next six months in the Netherlands (Article 2.38 Wet BRP). Without it you have no BSN, so you cannot be put on a Dutch payroll, take out health insurance or obtain DigiD, and the municipality can impose a fine.
How do I choose the right residence permit?
Start from the purpose of your stay: highly skilled work, a single permit, study, family, self-employment or a start-up. The IND assesses the application only against the purpose you chose and refuses it if the conditions are not met. Check the current income thresholds on ind.nl, as they change on 1 January and often on 1 July.
Do I have to declare foreign income in the Netherlands?
If you are resident in the Netherlands for tax purposes, you generally declare your worldwide income to the Belastingdienst, with double taxation relieved under the applicable treaty. Residence is decided on the facts, not on your permit. We do not give tax advice; consult a tax adviser early.
Is health insurance compulsory for expats?
Almost everyone who lives or works in the Netherlands must take out Dutch basic health insurance. If you do so within four months after the obligation arose, the cover is backdated and you pay the premiums for that period. Remaining uninsured leads to warnings and fines from the CAK.
